Terms of Use, No Refunds Policy, and Liability Waiver

This MTC Rider Academy E-Course Curriculum, including its videos, documents, and other associated content (hereinafter collectively referred to as "E-Course"), has been produced by DanDanTheFireman LLC (hereinafter collectively referred to as "MTC Rider Academy"). When you purchase our E-Course, you agree to these Terms of Use, No Refunds Policy, and Liability Waiver.

MTC Rider Academy offers you a nonexclusive, nontransferable, revocable license to access and use our copyrighted E-Course and its materials solely for your own personal and noncommercial use by purchasing this E-Course. Our E-Course is copyright protected in the United States. It is forbidden for you to copy, redistribute, utilize, or publish any content within our E-Course. You do not have any ownership rights to our E-Course after you purchase it. If you violate the terms of this Agreement, your access to the E-Course and its contents may be terminated. No refunds will be provided for any purchases of the E-Course.

Skilled riders demonstrate the lessons presented in this curriculum on a closed course. Do not take part in this E-Course curriculum or any motorcycle and/or bicycle activity if you are unable to completely follow the instructions in this E-Course.

Motorcycling and bicycling are inherently dangerous activities. While this E-Course is intended to make you a safer rider, we cannot control your motorcycle and/or bicycle on your behalf, much less for other riders, drivers, bicyclists, or the environment.

As a result, MTC Rider Academy explicitly disavows any and all liability for any injury, damage, or death caused by your use of a motorcycle, bicycle, or the application of this E-Course.

The E-Course skills, exercises, and strategies are all intended to improve your rider safety, comfort, and confidence. The information in our E-Course is provided solely for educational purposes and is by no means exhaustive or complete with regard to the scope of the subject matter. It does not serve as a substitute for federal or state licenses. We make no guarantees or warranties that the information in our E-Course is appropriate for you or will result in the improvement of your riding skills.

In exchange for being allowed to participate in DanDanTheFireman, LLC ("MTC Rider Academy")'s online E-Course, which will provide information, teaching, and technical skill on motorcycle riding and/or bicycle riding (the "Activity"), and in recognition of MTC Rider Academy's reliance thereon, I, the individual named below (referred to as "I" or "me") agree to all of the terms and conditions set forth in this instrument (this "Release"):

This agreement waives any right I have, or may have in the future, to sue MTC Rider Academy, its officers, agents, and employees (collectively, hereinafter known as “Releasees”), for any loss, damage, expense or injury to myself, disability, including death, arising out of my use of the motorcycle training, resulting from or related to my participation in the Activity, facilities (including, but not limited to facility and location owner not owned by MTC Rider Academy or any other entities and companies allowing MTC Rider Academy and Releasees to use their parking structure or building structure, collectively known as facilities), or equipment of MTC Rider Academy and Releasees, or my participation in activities involving MTC Rider Academy and Releasees, due to any cause whatsoever, INCLUDING NEGLIGENCE ON THE PART OF MTC Rider Academy and Releasees or otherwise. I covenant not to make or bring any such claim against MTC Rider Academy or any other Releasee.
